Roberta Guaineri provides legal and procedural assistance to legal entities and individuals in criminal trials and has since the 1990s participated in the most important trials in the field of corporate and economic criminal law.
She advises Italian companies and multinational corporations operating in the fields of public administration, finance and credit, construction, energy, environment, public and private health, copyright, communication and information.
She assists in investigations before the Supervisory Authorities in cases with possible criminal implications (Consob, etc.).
In the area covered by Legislative Decree No. 231/01, concerning administrative liability of companies for offences committed by directors or employees, she provides both preventive advice - involving drafting and assessing Organisational Models - and assistance to companies in criminal proceedings in connection with the offences envisaged by the legislation in force.
Likewise, with regard to Legislative Decree No. 231/01, she holds refresher courses for directors and employees of various companies and lectures on the subject at conferences organised as part of the mandatory professional training of lawyers and chartered accountants.
She has been, or still is, a member and Chairman of several Supervisory Boards of listed and unlisted companies.
Author of publications on corporate criminal law in specialised magazines and co-author of books on white-collar crimes, she often participates as a speaker in conferences on the subject.
Education
Degree in Law, with full marks, from the State University of Milan, with a thesis in Commercial Criminal Law (Professor Alberto Crespi) entitled “Profili di Responsabilità penale degli amministratori nei Gruppi”, 1991.
